If your father passed away without a will, his property is divided equally among all legal heirs under the Hindu Succession Act, 1956 — sons, daughters, widow, and sometimes others. If a co-heir is refusing to give you your share, you can file a Partition Suit in the civil court in Patiala.
This is a very common situation in Punjab. After buying property, the revenue record — called the fard jamabandi — needs to be updated in your name through mutation or intkal. Until this is done, the government still shows the old owner’s name.
We file a suit for recovery of possession in the civil court asking the court to order the person to vacate your land. If there is immediate risk of construction or damage, we also apply for a Temporary Injunction the same day — an urgent court order stopping any further activity on the property while the main case is heard. The longer someone occupies your land without challenge, the more complicated the matter becomes. Act quickly.
File a formal written complaint before the Tehsildar, then escalate to the SDM if needed. If both do nothing, we file Civil Suit and writ petition, directing the Revenue Department to complete your mutation. Courts treat government inaction very seriously. In our experience even receiving the Court notice causes the revenue authorities to complete the mutation almost immediately.
